Water Rights in Colorado

As a homeowner in Colorado it is important to understand your water rights due to the special nature of the issue in this state. Water in Western Colorado depends on water from the natural year-round flow of rivers and streams. More people live in Western Colorado than can be supported naturally because the water is managed to meet all the water needs of the communities below Colorado.

Snowmelt


Water flows at different rates throughout the year. Spring and summer are the largest water flow months, while in fall and winter the flows reach their lowest level. About two-thirds of the water flows take place in late spring from the snowmelt. The rivers and streams run very high and fast for a short period of time, which is why reservoirs were created to trap this water and use it for future use.

Where does my water come from?


The water comes from the city's water utility department in most residential areas. They provide water for drinking, bathing, wash, and gardening. Some areas are not attached to the residential water supply and have their own well and sewer, while other areas have an irrigation company that supplies water to fields and crops. Domestic utility provides the drinking water to your home. Drinking water service is set up similar as other utilities. Your realtor can provide you with the name of the domestic provider that services your area. It is your responsibility to contact the utility and set up an account and service.


Where does the water for my lawn come?


Western Colorado is a semi-arid desert that does not receive enough precipitation per year to irrigate a lawn or garden. The best landscaping ideas in this area is to use native grasses, plants and shrubs that require less water. Sprinkler systems receive water from either domestic water provider or an irrigation company. Water from an irrigation company is untreated and NOT suitable for drinking, washing clothes or cars. It is only suitable for watering gardens or lawns.


Is access to irrigation water transferred when the property is purchased?


Ownership of a share of irrigation water requires a separate transaction and deed. Many times the irrigation water is tied to the land. The realtors at ERE can direct you to the irrigation company that services Summit County.
